Draft for legal review

This document is a working draft prepared during development. It must be reviewed by an Australian legal practitioner before PoolPreCert is launched commercially.

Inspection disclaimer

PoolPreCert is an inspection assistance and management platform. It helps people identify possible pool barrier issues and manage inspection records. PoolPreCert does not issue pool safety certificates and nothing in PoolPreCert is a certificate, a determination of legal compliance, or a substitute for an inspection by an appropriately licensed professional.

Three different things

  • Preliminary homeowner checks are self-assessments completed by the property owner using PoolPreCert's guided checklist. They may be incomplete or inaccurate.
  • Professional inspection records are records created by professionals using PoolPreCert. Responsibility for their content rests with the professional.
  • Official certification — in Queensland, a pool safety certificate (Form 23) can only be issued by a pool safety inspector licensed by the Queensland Building and Construction Commission (QBCC). PoolPreCert does not issue certificates.

AI photo analysis

AI observations are generated automatically from photographs and can be wrong. The AI cannot measure distances, cannot confirm that a gate self-closes or self-latches, and cannot see components that are hidden or out of frame. Every AI observation should be physically verified.

Compliance rules

PoolPreCert's Queensland checklist is based on publicly available guidance from the QBCC. The legally binding requirements are set out in Queensland legislation, the Queensland Development Code MP 3.4 and the Australian Standards it references, which may contain detail not reflected in PoolPreCert. Requirements change over time and differ between states and territories.
